Should Smoking Be Illegal?

Smoking involves burning a substance to take in its smoke into the lungs. These substances are commonly tobacco or cannabis. Combustion releases the active substances in them, like nicotine, which are absorbed through the lungs.

A widespread technique through which this is done is via smoking manufactured cigarettes or hand-rolling the tobacco ready for smoking. Almost 1 billion people in the majority of all human societies practice smoking. Complications directly associated with smoking claim the lives of half of all the persons involved in smoking tobacco or marijuana for a long time.

Smoking is an addiction because tobacco contains nicotine, which is very addictive. The nicotine makes it difficult for a smoker to quit. Therefore, a person will become used to nicotine such that he/she has to smoke to feel normal. Consequently, I think smoking should be banned for some reason.

One reason why smoking should be banned is that it has got several health effects. It harms almost every organ of the body. Cigarette smoking causes 87% of lung cancer deaths and is also responsible for many other cancer and health problems. 

Apart from this, infant deaths that occur in pregnant women are attributed to smoking. Similarly, people who stay near smokers become secondary smokers, who may breathe in the smoke and get the same health problems as smokers. Although not widely smoked, cannabis also has health problems, and withdrawal symptoms include depression, insomnia, frustration, anger, anxiety, concentration difficulties, and restlessness.

Besides causing emphysema, smoking also affects the digestive organs and the blood circulatory systems, especially heart arteries. Women have a higher risk of heart attack than men, exacerbating with time as one smokes. Smoking also affects the mouth, whereby the teeth become discolored, the lips blacken and always stay dry, and the breath smells bad.

Cigarette and tobacco products are costly. People who smoke are therefore forced to spend their money on these products, which badly wastes the income they would have otherwise spent on other things. Therefore, I think that smoking should be forbidden to reduce the costs of treating diseases related to smoking and the number of deaths caused by smoking-related illnesses.

However, tobacco and cigarette manufacturing nations would lose a lot if smoking was to be banned. I, therefore, think that it should not be banned. Some nations largely depend on exporting cigarettes and tobacco products to get revenue.

This revenue typically boosts the economy of such nations. If smoking were banned, they would incur significant losses since tobacco companies are multi-billion organizations. Apart from these, millions of people will be jobless due to the ban.

The process by which tobacco and cigarette products reach consumers is very complex, and it involves a chain process with several people involved in it. Banning smoking, therefore, means these people will lose their jobs, which most may depend on for their livelihoods.

In conclusion, the ban on smoking is a tough step to be undertaken, especially when the number of worldwide users is billions. Although it burdens nations enormously in treating smoking-related diseases, it may take a long time before a ban can work. Attempts by some nations to do this have often been met with failures.

Smoking should be banned by higher authorities in all public places, although this would restrict some other people’s freedom. I completely agree with this statement because, firstly, it affects other people’s health, and secondly, it sets a good precedent for society and communities.

To begin with, smoking in all public places should be banned by the government because it affects not only active smokers who are addicted to it but also others who do not smoke. Moreover, when a person smokes in a public place, the smoke contains different hazardous gases. It deteriorates the environment as well as the health of the people who stand behind him. Moreover, smoking is a veiled threat to the health of passive smokers. If the central focus of the government is a restriction of smoking in public places, that would help people improve their health, and their lives would lead towards an impressive growth trajectory . For example, a study has revealed that the number of smokers has declined due to proper restrictions on smoking.

Moreover, the government should go beyond the conventional domain to ban smoking in public places. Due to this, more people will be aware of the consequences of smoking, and they will avoid active smoking. Moreover, if the government organizes stringent rules and regulations , people will think twice before smoking. It also sets a good precedent for others, and when they avoid smoking, it will help them develop their holistic growth . For instance, in the United States, a paradigm shift was seen in the number of people aware of the consequences of smoking because they followed stringent rules and regulations set by the higher authorities.

To conclude, smoking should be banned in public places, and I agree with this statement because it not only affects other people but also it is a prudent approach for society and communities.

Medical studies have shown that smoking not only leads to health problems for the smoker, but also for people close by. As a result of this, many believe that smoking should not be allowed in public places. Although there are arguments on both sides, I strongly agree that a ban is the most appropriate course of action.

Opponents of such a ban argue against it for several reasons. Firstly, they say that passive smokers make the choice to breathe in other people’s smoke by going to places where it is allowed. If they would prefer not to smoke passively, then they do not need to visit places where smoking is permitted. In addition, they believe a ban would possibly drive many bars and pubs out of business as smokers would not go there anymore. They also argue it is a matter of freedom of choice. Smoking is not against the law, so individuals should have the freedom to smoke where they wish.

However, there are more convincing arguments in favour of a ban. First and foremost, it has been proven that tobacco consists of carcinogenic compounds which cause serious harm to a person’s health, not only the smoker. Anyone around them can develop cancers of the lungs, mouth and throat, and other sites in the body. It is simply not fair to impose this upon another person. It is also the case that people’s health is more important than businesses. In any case, pubs and restaurants could adapt to a ban by, for example, allowing smoking areas.

In conclusion, it is clear that it should be made illegal to smoke in public places. This would improve the health of thousands of people, and that is most definitely a positive development.

Smoking Should Be Banned in Public Places

Smoking has been proven scientifically that it can cause many health factors such as lung cancer, heart disease, emphysema, and many more. Despite this knowledge that has been passed on through generations of how many health concerns smoking leads to, people continue to smoke themselves, or around other people. Smoking causes danger to one’s health but now with further research there is now evidence suggesting smoking can cause problems for those around you.

There is evidence everywhere proving how bad smoking is to one’s health, but how about the loved ones that surround you? Children are known to be more prone to diseases and illnesses than adults. At such a young age where the body is developing and preparing itself for the future, when exposed to these harmful contaminants it can cause serious damage to them. Children that are exposed to secondhand smoke tend to have more ear infections, coughs and colds, respiratory problems, tooth decay and much more. In the case where a child is diagnosed with asthma, the smoke that is being puffed into the air can become a trigger to it. Asthma is a condition in which a person’s airway becomes inflamed making it difficult for them to breathe. When a child with asthma breathes in secondhand smoke it leads to more asthma attacks, and can cause the attacks to be much more severe. According to Centers for Disease Control and Prevention (CDC) secondhand smoke causes, “acute lower respiratory infections such as bronchitis and pneumonia in infants and young children.” Secondhand smoke is exposed in many places, parks, beaches, schools, and playgrounds. These are all environments in which children thrive and play.

Secondhand smoke can also have long-term risks to children. The act of public smoking poses a threat since it also sends a message to the children that watch. People learn the most starting at a young age, when exposed to those that smoke in public they can learn that smoking might be okay. According to an article by Ronald Bayer and Kathleen E. Bachynski, “By challenging the perception of smoking a normal adult behavior, smokefree policies can change the attitudes and behaviors of adolescents, resulting in a reduction in tobacco use initiation” (HealthAffairs). The exposure of tobacco use at a young age can influence adolescents to act at an early age. This can possibly cause children to learn that it may be fine to smoke since adults are doing it. Due to this reasoning children can act upon this mindset and smoke at an early age which can damage their developing bodies. These children are too young, therefore do not possess the necessary knowledge to realize that these actions are in fact harmful and could possibly kill them. The forbidding of smoking in public places, frequented by the public like parks, playgrounds, outlets, or beaches, can prevent children from learning about these habits in the first place. When seen, children will think that this is a common adult behavior and will try to copy them. Children are at risk of learning these bad habits, but so are young adults. Teenagers at the age of 13-17 tend to worry more about their social life. In doing so, they commit stupid actions such as smoking to look cool. These young teens can pick up used or sometimes accidentally thrown away cigarette packets to smoke in front of their friends to gain some type of recognition. In doing so they are also affected since they are still young. It can become a terrible habit, in which can become very addictive. This results in them smoking for years and years, and what’s worse is they started at such a young age. The ban on public smoking doesn’t always have to be the result of complaints of secondhand smoke but to assure the safety of our children’s future.

Areas where children reside may also implicate that there are parents around, and in some cases pregnant mothers. When a mother breathes in secondhand smoke it also affects the baby inside her stomach. Mothers exposed to secondhand smoke can have many risks. Stated in an article by the American Academy of Pediatrics, “when you’re pregnant, your baby is exposed to harmful chemicals which cause miscarriage, premature birth, lower birth weight (which could mean a less healthier baby), sudden infant death syndrome (SIDS), and learning problems and attention-deficit/hyperactivity disorder (ADHD).” According to data from NIIH, secondhand exposure during the late 1900s for women have been exponentially high. Around the 1980s, up to 80% of women that are age 4 years and older were exposed to secondhand smoke. The puffs of smoke left in the air where children and mothers roam have a huge negative impact on their health. This is a concerning issue and by forbidding smoking in public places we can safely assure the health of our loved ones.

Secondhand smoke and smoking aren’t the only problems the public worry about, there are also cases which affect the environment. In public settings surrounded by buildings such as restaurants, parks, work buildings, and houses there are times when smoke fires can occur. Smoke fires are disasters that are caused by smoking-related fires. According to a study by UC Davis Health (published in 2000), smoking is a leading cause of fire disaster and death worldwide. This is a problematic issue since there are those that can be affected by this fire. There are many unfortunate cases that are results from these smoking-related incidents such as the Oakland Hills fire in California. Also stated by UC Davis Health, “in which a lit cigarette remains a suspected cause, left 10,000 homeless, destroyed nearly 4,000 dwellings and cost more than $1.5 billion.” This problem is a major concern for the public’s safety and it’s also costing a fortune to fix. Smoking-related fires are costing over 27$ billion yearly, the California, Oakland Hills fire costed more than $1.5 billion, the fire in Mont Blanc Tunnel costed over $1 billion, and the ammonium nitrate explosion costed more than $4 billion dollars. These disasters were all accidents but they all have the same culprit which are discarded cigarette buds not properly put out. Many public areas today and in the past are known to have thousands to millions of discarded cigarette buds lying around on the streets. If not properly put out they can create disastrous outcomes that affect everything around it whether it is people, animals, and the environment. Some found in commercial areas such as piers where it’s built upon a wooden base. Situations in which someone accidentally does not distinguish the flame properly can accidentally cause a fire. Ban of the use of cigarettes in these public areas, especially in flammable areas, can prevent any further possible outbreaks.

Disposed cigarette butts are primarily found in public areas such as parks, playgrounds, beaches, sidewalks, and commercial areas. All once areas that were free of these waste, now cluttered of trash, make it hard for people to enjoy the overall appearance. Nobody likes to see a street or outlet full of these cigarette butts. This all contributes to earth’s overall pollution. These discarded cigarette butts can become a potential choking hazard to wildlife and children that find it on these areas. There can be situations in which a young child playing in the sand at the beach or playground can find a cigarette butt and be tempted to put it in their mouth. This holds many risks since the cigarette butts contain many chemicals that are harmful to one’s body. Wild animals roam human populated areas all the time, such as birds. Birds and other wild animals can pick these discarded cigarette butts which they may mistake as food.

The ban on public smoking should have been inputted long ago. Many people consider this ban either because it’s a health issue, a concern due to the impact it has on young minds, or just because it is a nuisance to them. There are many activities that were banned due to the possible impact it had on children, these activities include sexual acts in public,gambling, and nudity. With so many negative impacts smoking has on the smoker or those around it, it would make sense to implement a law where smoking is banned in public places.

The positive effects of banning public smoking outweighs the negative.

The idea of smoking in colleges and campuses has developed a mixed reaction in the USA and in many other parts of the world such that it has posed a very hot and contentious universal debate.

Several campuses and colleges have tried to impose a total ban on smoking within their environs, some of them succeeding while others failing to do so. For instance, colleges like Santa Ana and Fullerton have managed to ban smoking completely within their environs, while others such as Huntington Beach and Golden West College still allow smoking in prescribed places such as in parking lots.

Fullerton College was the first to successfully impose a smoking ban in the year 2007 (Bates 57). Nevertheless, many colleges and campuses have not managed to follow suit because of some state laws which assert that smoking is only proscribed inside buildings and within 20 feet from entry points of buildings in all campuses. These laws continue to give students the right to smoke within certain areas of their campuses.

As aforementioned, section 7595 of the government code affirms that smoking is proscribed only in public buildings and within 20 feet from entry points of buildings in all campuses (Merrill 36).Therefore, the opponents of this subject believe that since it is the right of every citizen to do anything that is recognized as legal, it is very wrong to impose a total ban on smoking, especially in campuses.

The most important thing is to ensure that students follow the laid down rules and regulations such as the strict use of the recommended areas of smoking. In deed, it is very unfair to send students off campus to smoke.

In addition, the opponents of this argument believe that smoking should not be banned because it helps students to relax whenever they are in stressful situations. Concerning the health risks that are brought about by smoking, they assert that every mature citizen should be in a position to separate good behavior from wrong behavior.

They say that since there has been an integration of cigarette smoking topics in schools for several decades, by the time a student reaches campus, he/she must be in a position to understand the risks that cigarette smoking poses to their health and therefore they should be able to make informed decisions about smoking. They also argue that it is very unfair to impose an immediate ban on cigarette smoking in campus yet it is clearly understood that smoking is an additive activity which can not be stopped at once.

Even though campus students have the right to smoke within some prescribed areas whenever they wish to do so, as mandated by some state laws, they ought to realize the fact that cigarette smoking has got very serious and detrimental effects on human health. Smoking of cigarettes can bring about lung infections to both first-hand and second-hand smokers. Therefore, smokers need to recognize that their right to smoke may greatly infringe on the rights of their non-smoking counterparts.

It is obvious that students know the negative effects of smoking cigarettes. For instance, it is expensive for them and it may also reduce their lifetime. Generally speaking, cigarette smoking is just bad. Currently, at least forty three colleges in the USA have imposed a total ban on cigarette smoking in their campuses and this trend is increasing especially among commuter schools and community colleges (Merrill 40).

However, it is hard to impose such a ban in some colleges because of the mixed reactions that are held by different stakeholders about the issue of smoking, and the existing campus policies which give the smokers the right to smoke in prescribed areas. According to the research that was carried out by the U.S. Department of Health and Human services, 31% of college students smoke cigarettes. This figure exceeds the national general average of 25% (Longmire 15).

It is also worth to note that even though there has been an integration of cigarette smoking topics in schools for several decades, cigarette smoking has continued to attract many youths and this continues to raise a lot of alarm about their future. This is because cigarette smoking is the major contributor of the cases of lung cancer in the entire world.

Research indicates that close to eighty percent of men who die from lung cancer, and seventy five percent of women who die from the same disease do so because of smoking tobacco. Research also indicates that the risk of lung cancer increases when a person starts smoking at an early age, and with an increase in the number of cigarettes that a person smokes in a day (Robicsek 56).

Scientific research has proved that cigarette smoking is harmful to the body. The smoke that comes out of a burning cigarette is a compound mixture of several chemicals which are produced when tobacco is burned.

This smoke contains a deadly compound called tar, which consists of more than four thousand chemicals which are very poisonous, and a majority of them have been clearly identified to be the main cause of cancer. Most of these chemicals are also known to cause lung diseases and heart problems. Some of these chemicals include cyanide, benzene, methanol, ammonia, formaldehyde and acetylene (Merrill 45).

Other deadly substances that are found in cigarettes include carbon monoxide and nitrogen oxide gases which are very poisonous. The most active component of a cigarette is nicotine. Nicotine is a very addictive compound. Cigarette smoking can cause several problems such as cancer, lung damage and heart infections among many other diseases.

Research also indicates that more than thirty percent of the deaths that result in the United States occur due to the use of tobacco. Cigarette smoking also causes eighty seven percent of the deaths that result due to lung cancer. Other types of tobacco-related cancers include mouth cancer, cancer of the larynx, cancer of the throat and esophagus and cancer of the bladder. There is also a very close connection between cigarette smoking and the occurrence of the cancers of the kidney, pancreas, stomach and the cervix.

Cigarette smoking can also cause lung damage which begins at the early stages of smoking. Cigarette smokers encounter many problems with their lungs as compared to non-smokers and this situation gets worse when an individual increases his/her capacity to smoke. Smoking is linked to many dangerous lung infections which are just as perilous as lung cancer. These infections include emphysema and chronic bronchitis which cause difficulties in breathing and may even cause death.

Cigarette smoking also augments the risk of heart infections which stand out as the major causes of deaths in the U.S. Out of all the risk factors of heart infections, i.e. excess cholesterol, diabetes, obesity, cigarette smoking, physical lethargy and high blood pressure, cigarette smoking remains the leading risk factor for impulsive deaths that result from heart attacks (Bates 78).

In addition, low levels of cigarette smoking which may not be able to cause lung infections are capable of damaging the heart. Therefore, second-hand smokers also stand a very high chance of getting heart infections.

As stated earlier, Section 7595 of the government code affirms that smoking is proscribed in all public buildings and within 20 feet from entry points of buildings in all campuses (Merrill 36). Even though this ruling is good, it is not sufficient because it seems to discriminate the innocent second-hand smokers who continue to suffer from cigarette smoke which pollutes the air around them.

Cigarette smoking has also very detrimental effects to the real smokers and therefore they should be able to accept this ban because it is meant for their own good. Though it is very hard to ban citizens from doing something which is legally right, smoking should be gradually banned in campuses so as to protect the non-smokers. This is because campuses are public places which consist of both smokers and non-smokers.

My stand on this issue differs significantly from my opponents who believe that smoking should be allowed in some prescribed areas in campuses. My stand is that cigarette smoking should be banned in campuses because it impacts negatively on the non-smokers. Banning of cigarette smoking in campuses would enable the non-smoking citizens to enjoy the delight of breathing unpolluted air.

Nevertheless, my stand does not include cigarette smoking in private places such as in homes. At the same time, cigarette smokers should understand that the non-smokers are not trying to be intolerant when they keep on complaining about them. Rather, they are doing it for the sake of their own health.

In conclusion, smoking should be totally banned in campuses and colleges because of its severe health risks to both smokers and non-smokers. The health risks are much more to non-smokers because they may double up especially to those who already suffer from other ailments such as heart and lung problems.

In addition, a very short exposure by a non-smoker to secondhand smoke may have abrupt severe effects on his/her cardiovascular system thus escalating the risk for lung and heart infections. This makes the non-smoker to have a higher risk of catching infections from cigarette smoke than the real smoker yet he/she is very innocent. A more effective way of reducing smoking in campuses would be to provide tobacco termination counseling programs in the campuses.

I stumbled out of the building, coughing and wheezing, smoke filling my eyes and lungs. I tugged frantically at my tie to loosen my collar, my head pounding as I ran out the door.

...fresh….air….gotta….have….fresh…..air…

Was it a fire?

Terrorist attack?

No, I was simply eating my dinner when a gentleman at the table next to us decided to light up a cigarette. The smoke went right into my face and lungs. All of a sudden I couldn't breathe, my chest hurt and I panicked.

Ladies and gentlemen, by the end of this year more people will die from second hand smoke related deaths than the average crowd at a Major League Baseball game. Secondhand, or passive smoke, is an insidious killer that is harming adults, and more critically, children around the country every day.

My goal in speaking to you today is to enlist your support in a federal ban of all smoking from all public places without hesitation.

But isn't this America? Shouldn't I have the right to smoke? If I want to pollute my lungs and ruin my health, why should that be any concern of yours?

The facts are that secondhand smoke is responsible for many of the same diseases as if the sufferers had smoked the cigarettes themselves. These diseases include cardiovascular diseases, lung cancer, and respiratory diseases.

For example, the International Agency on Research on Cancer found that “involuntary smoking is carcinogenic to humans." Various studies in the United States, Australia, and the United Kingdom point to a significant increase in risk of lung cancer among those exposed to passive smoke.

The California Environmental Protection Agency found that passive smoking increases the risk of breast cancer in young women by 70%. In a separate paper, the US Surgeon General found that there was evidence that suggested that there was a causal relationship between smoking and breast cancer.

Secondhand smoke is even associated with the loss of hearing in non-smoking adults.

What? What did you say?

Studies have shown that both active and passive cigarette smoking increases the risk of their atherosclerosis. Also, exposure to secondhand smoke increases the risk of cognitive impairment and dementia in adults 50 and over.

And our children?

Putting children at risk is unforgivable at best and probably criminal. In a 2006 report, the US Surgeon General found that the evidence is sufficient to infer a relationship between secondhand smoke and sudden infant death syndrome.

And - horrifyingly - the risk of developing brain tumors is higher among children exposed to passive smoking, even if the mother does not smoke.

The California Environmental Protection Agency found that the risk of childhood cancer (and adult lung cancer) increases after childhood exposure to passive smoking.

Sadly I could go on, and on, and on. And on!

Secondhand smoke in the home is one problem. But to go to a public restaurant, or concert, or any event and to experience secondhand smoke is impacting the health of our population and increasing healthcare costs. Without doubt, it should be banned by federal mandate in the next session.

While you have the option of whether to smoke or not, I DON'T have the option of not breathing.

Nor do our children.

I have chosen to speak about a possible ban of smoking in all public in areas in Australian states, attempting to persuade the audience that the ban is beneficial to the population and should be implemented. Feedback would be much appreciated! "Everyone, even the apparent one-sided marketing teams of tobacco companies, can acknowledge that smoking is bad for people's health. Pictorial evidence of its dastardly effects, strewn across each deck of 20s, public health posters extolled with "SMOKING KILLS" in vivid text remind us each day. On a serene, sunny afternoon in a Melbourne cafĂŠ, I often find the aromatic scene suddenly interrupted by the pungent scent of tobacco wafting from a gentleman lighting up beside my table, and the sudden shift of the other Melbournian customers as they attempt to avoid breathing it in. As one of the most common and unhealthy of human habits, smoking, generally in public, had been regarded as a personal choice that bystanders had little control over. Now, for the first time, the act of public smoking is becoming regulated, even restricted in some instances. Many believe that it should be prohibited as it influences every person devoid of their own approval, whereas tobacco users believe that their right to personal, private use of tobacco is being stolen from them. Nonetheless, it's time for smoking in public to butt out. Since 2004, Victoria and a number of other states have been campaigning to restrict the act of smoking - starting with proposals to make clubs, pubs and bars smoke free. In the new age of 24-hour gyms, shake weights and electronic cigarettes, Australia has been gradually moving towards a healthier population. The story is that in recognition of the harmful effects of exposure to environmental tobacco smoke, the Australian government are taking intervention to curb the problem of public smoking, taking legal action in regards to implementing a law that prohibits smoking in all public places, including outdoor dining and drinking areas. Perth has already implemented a ban, with Melbourne hot on their heels. Melbourne Councillor Richard Forster states that no-smoking boundaries have been extended "around play areas ... childcare centres and hospitals," and that "it's about time that we made it simpler for smokers and everyone else." I, like 70% of people surveyed in 2010 Cancer Council Victoria Survey, agree that this smoking ban would be beneficial and approve of smoking bans in outdoor areas, although, of course, there are those who oppose it. Among the minority, smokers and tobacco users and some members of the population are fighting to preserve their rights. Many believe that smokers have the right to enjoy themselves. They believe that the ban is unnecessary as it restricts liberties too much, that it has gone "too far" in the plight for a healthier city. Whilst all humans do have a right to enjoy themselves, they should not be allowed to so when endangering the health and safety of other human beings. Serial killers enjoy killing people, but it is against the law to do it. Smokers endanger the lives of more than themselves when they smoke in public places. It is also believed that the ban would be difficult to enforce, as smoking is a common and popular occurrence. However, after being trialled in some countries, compliance rates have shown to be quite high, with a smoking ban in Scotland evoking a compliance rate in excess of 99% after just three months. Scotland made it work, so what's stopping Australia? Many laws are difficult to enforce, though to protect the public, it is necessary. It is also believed that the introduction of the ban would have a drastic effect on some businesses. Smoking is considered to be a part of nightlife culture, and that if smokers are not allowed to smoke in pubs, they will not spend as much time in them and revenue will be lost. However, although smokers may cause initial losses, pubs and restaurants will gain money from those who are more likely to eat or drink somewhere if they know they will not have to breathe in second hand smoke. After a state smoking ban in Wisconsin, Savanna Oehrle, manager of a local village pub, stated that despite losing some customers, "a lot of non-smokers would stay longer because it wasn't so smoky." It's possible. So what else does this ban have to offer? With nearly 4000 Victorians dying of smoke-related illnesses each year, I think Australia can afford to make a change. Although some smokers may argue the ban is pointless, it is likely to provide many benefits. The ban would reduce public exposure to second hand-smoke, saving non-smokers from being exposed to its hazards. Those exposed to second-hand smoke can experience similar effects to those who smoke directly. According to the World Health Organisation, second-hand smoke contributes to over 600,000 deaths per year, from causing conditions such as serious cardiovascular and respiratory diseases. With the smoking ban proposing principles such as preventing smoking within 10 metres of places like playgrounds, is it not justifiable to prevent citizens, even children, from exposure to these potential effects? Arguably, the ban would make it more difficult for smokers to find suitable places, though this would be advantageous. It would make it difficult for smokers to keep up with their habit. Not being able to smoke in a pub, a smoker would have to go outside, to possibly face the wrath of unpredictable Melbourne weather, away from their non-smoking friends every time they wanted a cigarette. This would be likely to influence someone to at least consider giving up, or even to smoke less frequently. When a smoking ban in public was introduced in England in 2004, after 9 months there was a fall of 5.5% of the number of smokers in the country, compared to the 1.1% fall before the ban. Low compliance: Despite the ‘No Smoking’ sign, many restaurant owners or their workers hesitate to enforce the rule for fear of confronting aggressive smokers.

PETALING JAYA: The lack of enforcement of the smoking ban in public places, especially at eateries, in some areas has led to customers lighting up at these premises.

The Tobacco Products Control Regulations 2004, enacted under Section 36 of the Food Act 1983, declared all food and beverage outlets to be non-smoking areas.

Federation of Malaysian Consumers Association (Fomca) chief executive officer Saravanan Thambirajah said enforcement seems to be stronger in urban regions than in rural ones.

He said consistent enforcement on the smoking ban is required to ensure complete compliance.

“There are limited enforcement officers, which makes it difficult to monitor all eateries effectively,” he said.

To enhance enforcement, the government should consider increasing the number of health inspectors and provide them with adequate training and resources, Saravanan added.

“Implementing stricter penalties and running continuous public education campaigns to shift cultural perceptions of smoking are also vital.”

Fomca backs the implementation of sanctions, not only on smokers who violate the ban, but also on eateries that fail to enforce it.

“Publicly listing non-compliant eateries could also serve as a deterrent against non-compliance,” said Saravanan.

Consumers Association of Penang (CAP) president Mohideen Abdul Kader said that smoking prohibition is not strictly enforced at restaurants.

“Nobody seems to notice the board that reads ‘No Smoking’. Many restaurant owners lack the courage to warn smokers.

“They may advise against smoking to one individual, but if there are more than two smokers, they are afraid to speak up because they worry for their safety,” he said.

Mohideen said some smokers tend to be aggressive, and if there is misunderstanding at their premises over the right to smoke, they may lose customers.

“To resolve this, more enforcement officers must visit eateries. There is a need to extend power to the police and Rela (Malaysia Volunteers Corps Department) to also issue compounds,” said Mohideen.

More signage and pictures related to the risks of smoking must be put up near restaurants.

“The images have to depict the effects on non-smokers or second-hand smokers who sit near smokers. Pictures are more powerful than words,” he added.

The Malaysian Muslim Restaurant Owners Association (Presma) supports the move to enforce no-smoking in eateries.

“Some customers acted aggressively and even threatened to splash hot beverages on our workers’ faces when they were told not to smoke,” said Presma president Datuk Jawahar Ali Taib Khan.

“When enforcement officers make their rounds, they issue one compound to the smoker and one compound to the restaurant owner, which is not fair.

“The offence is committed by someone else but we have to bear the brunt of it,” said Jawahar, adding that early education on the ban on smoking at eateries and other public places is required and this should be done from primary school.

Regulation 11 of the Control of Tobacco Product Regulations 2004 stipulates that anyone found guilty of smoking at undesignated zones may be subject to fines of up to RM10,000 or up to two years’ jail.

For the offence of failing to put up no-smoking signage, owners of eateries face a maximum fine of RM3,000 or six months in jail. For failing to ensure that customers do not smoke at eateries, the fine is RM5,000 or up to six months’ jail.

The use of traditional cigarettes, vapes, shisha, cigars and other new smoking products is also prohibited under this law.
