Blueprint for future of the South Downs approved

Landscape and the needs of local communities are central to the new South Downs National Park Local Plan which has now been formally adopted.

The Plan covers the entire National Park for the next 14 years with the policies designed to preserve the nationally-designated landscape while creating new homes, work space and enhancing the natural environment.

The Plan sets out measures to mitigate climate change including that any major new developments should seek to be carbon neutral, have better drainage schemes to reduce flood risk and limit water consumption for new developments.

Margaret Paren, Chair of South Downs National Park Authority, said: “This is a significant moment for the South Downs National Park and our local communities.

“Our adopted Local Plan puts our nationally important landscapes first and ensures that they sit at the heart of every planning decision we make. But, while our first priority is to conserve and enhance the landscape, this Local Plan goes one step further by clearly outlining how we will nurture a living, thriving landscape that benefits local people and looks to increase resilience to climate change.

“The Local Plan includes over 50 Neighbourhood Plans developed by South Downs’ communities which provide local development management policies and allocate land for development. We are grateful to all those who spent so much time assisting us in developing the Local Plan.

“The exciting plan also sets out the high standards that all proposed development must meet to protect nature and the vital ‘ecosystem’ services it gives us such as clean water, food and space to breathe.”

The Plan replaces more than 1,000 overlapping policies that were in existence across the area of the National Park with 92 clear policies covering all aspects of planning.

It follows extensive public consultation with local communities and detailed scrutiny and examination by the Government’s Planning Inspectorate, which found the policies to be sound subject to a number of modifications.

The Local Plan has been informed by a range of factors, including the geography and geology, biodiversity and heritage sites of the National Park, Neighbourhood Plans, local economic needs and the impact of climate change.

Key highlights of the Local Plan include:

  • Services provided by the environment such as clean water and air, dark night skies and tranquility provided by the National Park.
  • As evidenced by feedback from local communities, growth is dispersed across the towns and villages of the National Park, rather than just allowing growth around the largest settlements such as Lewes and Petersfield.
  • This is provision of 250 dwellings per year across the National Park.
  • High goals for affordable housing – the bar is set at 50 per cent on sites of 11 or more new homes will have to be affordable.
  • Conservation of internationally-important landscapes such as Woolmer Forest and the Sussex Heritage Coast, for example.
  • Provision of 10.3ha of employment land to create jobs and support the rural economy.
  • Conservation and enhancement of “green corridors” to link up habitats and support wildlife, as well as promoting the planting of new trees and hedges.
  • Adoption of strategic sites that represent one-off opportunities for developments of exceptional quality – Shoreham Cement Works and North Street Quarter, Lewes.

APPENDIX C: PRIORITISATION OF INFRASTRUCTURE PROJECTS - PROCESS

The South Downs National Park Authority (SDNPA) is responsible for making the final decision on the allocation of funding raised through the Community Infrastructure Levy (CIL). This is achieved through an annual process of review, collection of bids and information and the preparation of a 5 year rolling programme of infrastructure projects – known as the Infrastructure Business Plan (IBP). This appendix sets out the decision making process including how the SDNPA identifies and agrees priorities for the use of CIL and allocation of the funds. Under the CIL Regulations1, the SDNPA as the ‘charging authority’ is able to retain 5% of the money received to cover its administration costs, then 15% or 25% should be passed onto local Parish / Town Councils as the ‘neighbourhood portion’2 (see Table 1). Where the Parish / Town Council’s priorities are the same as those of the SDNPA, for example if they are agreed a new school or highway improvements are needed, the Parish / Town Council can agree that the SDNPA can keep all or part of their 15% or 25% to ensure maximum funding is available for that particular infrastructure priority. In accordance with the CIL Regulations, the remaining CIL money (minus the administration costs and neighbourhood portion) must then be spent on infrastructure projects related to the SDNPA’s infrastructure needs.

In addition, Pot 1 will be allocated proportionally to the total value of the infrastructure projects which fall within the ‘critical’ or ‘essential’ category (see Table 2) to enable the service / infrastructure provider’s flexibility to deliver the projects as and when required. For example, an education authority (such as a County Council) may demonstrate that due to the housing growth within the National Park there is a requirement for £15 million to be spent on 4 school projects (new schools and / or expansion of existing). The SDNPA CIL receipts will never be able to meet the total £15 million, however, a proportion of Pot1 will be allocated to those projects. It will then be for the service provider to choose which of those 4 projects the money can be spent on and will be able to request access to the money from the SDNPA at the appropriate time.

THE PROCESS FOR THE CREATION OF THE INFRASTRUCTURE BUSINESS PLAN In summary, each year the SDNPA will have a ‘call for projects’, inviting local communities, service providers and other stakeholders to put forward projects for CIL funding (this call for projects will also include a review of existing information / evidence). Projects put forward for funding will then be assessed in three initial stages.

Step 1 – Basic Eligibility Test, when considering a project, the following questions will be asked: Is it infrastructure? Does it relate to and support the South Downs Local Plan and Neighbourhood Plans? If the answer is No to any of the above, then the project is not eligible for CIL funding. If the answer is Yes, then the project will move onto Step 2.

Step 2 – Category of Project, the SDNPA acknowledges that there will be a funding gap between the total cost of the infrastructure required and the money collected through CIL. Therefore, projects put forward for CIL funding will need to be prioritised (based on discussions with County Councils and other strategic infrastructure providers). Step 2 involves putting the projects into one of the following categories, as shown in Table 2.

This will also include projects linked to Neighbourhood Plans with no development allocations and Projects which fall within / close to Large Settlements / Neighbourhood Plans with allocations but the projects have no defined timescales / clear commitments (i.e. more aspirational).

Categorising projects is always going to involve an element of judgement and the category that a project falls within may change over time.

Step 3 – Scoring of Projects, projects will then be scored using the ‘Prioritisation Matrix’, see Table 3. In addition, projects will be put into the following 5 year periods based upon when they would be most likely to be required or delivered:  Short term (2019-2023);  Medium term (2024-2028), and  Long term (2029-2033). Where infrastructure providers, Parish / Town Council, local communities and others put projects forward for funding but do not provide a timescale, the SDNPA will identify them as ‘long term’. The SDNPA will also identify those infrastructure projects where Parish / Town Councils could use their ‘neighbourhood portion’ to deliver the project. If they so wish to, Parish / Town Council can also request the SDNPA to retain all or part of their 15% or 25% to ensure maximum funding is available.

The SDNPA’s Major Projects Team (within the Planning Service) will carry out this initial work and create the draft IBP, including initial recommendations of which projects should receive CIL funding for that particular financial year based upon the categories, scoring matrix and funding available. Once the draft IBP is created, extensive internal consultation will take place with the SDNPA’s Countryside and Policy Teams (CPM) and Senior Management Team (SMT), to see where they can 'add value' to projects, link projects together and confirm the prioritisation of projects, before it is recommended to the Planning Committee for approval. The Infrastructure Business Plan (IBP), including which projects will receive funding (within that particular financial year) will be presented to Planning Committee for approval annually. Once the IBP is approved, those projects that will be allocated funding that year will be subject to further detailed assessment. The Major Projects Team are working with Performance and Projects Team and Marketing & Income Generation Team to implement a project assessment process to ensure all bids for SDNPA funds (whether that be CIL, Strategic Fund or Sustainable Communities Fund) follow the same assessment process and where possible look for opportunities to joint fund projects. Those projects approved by the Planning Committee will be invited to submit further detailed information via ‘Projects for the South Downs’ (our online application process) at the appropriate time. Projects not allocated CIL funding for that particular financial year, will be carried over and reviewed for the following year(s) Infrastructure Business Plan (as the IBP sets out a 5 year rolling programme of projects).

Community Infrastructure Levy

What is Community infrastructure Levy (CIL)?

The Community Infrastructure Levy (CIL) is a charge on development which was adopted by the South Downs National Park Authority (SDNPA) on the 1 st April 2017. The funds collected by the SDNPA are then spent on infrastructure needed to support the growth (of the new developments) planned in the National Park. Some of this money is also directly paid to parishes in which the development occurred.

S106 and CIL – What’s the difference?

The new CIL charge aims to replace the majority of Section 106 legal agreements which are negotiated on a case by case basis.  The SDNPA will still have Section 106 agreements but these will be primarily used to secure affordable housing and any site-specific works.

Exemptions from paying CIL

There are a number of ways in which developments can receive full exemption or partial relief from paying the CIL charge.  Exemptions can be applied-for if the development is a self-build house, extension, or annexe. Social housing and developments under a charity can also be fully exempt from the CIL charge.

How is CIL spent by the Planning Authority?

CIL funds are spent on relevant infrastructure that is needed to support the local development of the area.  The levy is to be spent by the authority on the provision of new infrastructure and not used to remedy pre-existing deficiencies unless those deficiencies will be made more severe by new development.  The infrastructure the SDNPA will fund is pre-determined for the following year by the Infrastructure Business Plan (IBP).  The IBP is generated alongside the Local Plan which identifies the most ‘needed’ infrastructure. The list is updated yearly setting out plans for expenditure in a 5-yr rolling programme.

The ‘relevant infrastructure’ list (referred to as the ‘Regulation 123’ list) states which infrastructure projects or types of infrastructure the SDNPA intends will be, or may be, wholly or partly funded by CIL and those to be funded by S106. These include strategic flood management, education provision, play areas, leisure infrastructure, and sustainable transport to name a few. Money paid to Parishes

The amount of CIL money each Parish Council receives from new development within their areas depends upon whether there is a Neighbourhood Plan in place, as set out in the CIL Regulations 2010 (as amended).  Parish Councils with a “made” Neighbourhood Plan receive 25% of all the CIL funds collected from new development within their area. Those Parish Councils without a Neighbourhood Plan receive 15% and, in addition, their CIL funds are capped to £100 per council tax paying dwelling in a financial year. Parish Councils are required to keep records of payments received and how that money has been spent.  If Parish Councils do not spend the CIL money within 5 years of receipt, or spend the money other than in accordance with prevailing regulations, the money must be refunded.

Lewes Town Council has a Neighbourhood Plan, which was adopted as policy (“made”) in 2019 and since then has received the uncapped 25% parish share of relevant CIL each year.  Our statutory annual return to the SDNPA is available to view here .

What can a parish spend their portion of money on?

A Parish Council must use CIL money passed to it to support the development of the local council’s area, or any part of that area, by funding the provision, improvement, replacement, operation or maintenance of infrastructure.  Examples of expenditure for parishes include the provision of a sports hall, play area, bus stop, or education provision. Parish funds can also be used for the provision of affordable housing, unlike the SDNPA’s portion of CIL funds which cannot be used in relation to affordable housing.

Lewes Neighbourhood Plan contains a section (s11 p146) outlining the community’s wishes for application of CIL funds, and the Council has decided to ask the public, in 2021, to help prioritize the projects listed there.

Call for projects for the 2023 round of Community Infrastructure Levy funding – closes on 3rd March

You might think in these times of government cutbacks and reduced budgets for community spending that there are almost no funds available to help community projects. However there are funds available under the Community Infrastructure Levy (CIL) system. Basically, every time a planning authority gives permission for housing (excluding affordable housing) the developer has to pay a levy to the planning authority to help with funding community projects.  Each planning authority administers the scheme in their area which allows individual organisations, groups and parishes to put forward schemes which, if approved, get financial backing from the CIL funding “pot.” 

Within the  South Downs National Park the planning authority is the National Park itself. Here is their update on CIL funding:

The South Downs National Park Authority has opened the call for projects for the 2023 round of Community Infrastructure Levy (CIL) funding. The window for submission of Expressions of Interest will be open until 3 rd March 2023.

CIL funding is designed to be spent on infrastructure to support growth within the National Park. The priorities of the National Park’s corporate plan over the next three years are Nature Recovery, Climate Action and ‘ A National Park for All .’ The authority welcomes potential bids that support these priorities.

About CIL funding

The CIL collected by the SDNPA can be used to fund a wide range of infrastructure, including transport, flood defences, schools, play areas, parks, cultural and sports facilities.

When spending CIL, it is the intention of Government that the Authority focuses on the provision of new infrastructure.

CIL will help to bridge the funding gap in delivering infrastructure but it will never resolve it. Therefore there is a need to prioritise the infrastructure projects put forward to us for consideration. Please refer to the Infrastructure Business Plan (IBP) (which encompasses the Infrastructure Funding Statement) for details on the prioritisation process of infrastructure projects and an overview of projects which have secured CIL funding.

In areas where development has taken place, Parish or Town Councils will also receive direct CIL payment known as the ‘Neighbourhood Portion’ and have the ability to use this money on projects that are a priority for them. The regulations allow them to spend the money on a wider range of projects than the National Park Authority can. CHICAGO (AP) — The Chicago Bears unveiled a nearly $5 billion proposal Wednesday for an enclosed stadium next door to their current home at Soldier Field as part of a major project that would transform the city’s lakefront, and they are asking for public funding to help make it happen.

The plan calls for $3.2 billion for the new stadium plus an additional $1.5 billion in infrastructure. The team and the city said the project would add green and open space while improving access to the city’s Museum Campus and could also include a publicly owned hotel.

“This is not an easy project, but Chicago doesn’t like it easy,” Bears president Kevin Warren said.

The announcement at Soldier Field comes during a busy week for the Bears. They are expected to take 2022 Heisman Trophy winner Caleb Williams with the No. 1 pick in the draft on Thursday night and bank on the USC quarterback to solidify a position that has long been a sore spot for the founding NFL franchise.

The team said last month it was prepared to provide more than $2 billion in funding toward a publicly owned stadium in the city.

The proposal calls for $2.025 billion from the Bears, $300 million from an NFL loan and $900 million in bonds from the Illinois Sports Facilities Authority. The funding from the ISFA would involve extending bonds of the existing 2% hotel tax.

The Bears said the project would generate $8 billion in economic impact for the region. It would be built in three phases and take up to five years. The new stadium would be constructed on a parking lot just south of Soldier Field, the Bears’ home since 1971. The team’s lease at the 100-year-old stadium runs through 2033.

Mayor Brandon Johnson gave a full-throated endorsement, saying the project is in line with Daniel Burnham’s “Plan of Chicago.” He said there would be no tax hikes or new taxes for Chicago residents.

Renderings show the Bears’ stadium would have a translucent roof and massive glass panels that would bring in sunlight and allow for views of Chicago’s famed skyline. The plan is to host major concerts throughout the year as well as Super Bowls, Final Fours and Big Ten championship games.

Though Soldier Field’s famed colonnades would be preserved, the spaceship-like stadium that was installed in the renovation two decades ago would be torn out and replaced by playing fields as well as park space. The plan calls for a pedestrian mall, food and beverage options, a promenade and plaza.

“My administration insisted that any new project — especially one on public land — must deliver strong public benefit and public use for the City of Chicago, and I am pleased today that this plan does exactly that,” Johnson said.

Illinois Gov. J.B. Pritzker, however, said he wasn’t on board.

“I remain skeptical about this proposal and I wonder whether it’s a good deal for the taxpayers,” Pritzker told reporters Wednesday at an unrelated news conference. “I’m not sure this is among the highest priorities for taxpayers.”

Illinois’ top legislative leaders were also doubtful.

“If we were to put this issue on the board for a vote right now, it would fail and it would fail miserably,” Illinois House Speaker Emanuel “Chris” Welch said at an unrelated news conference. “There is no environment for something like this today.”

However, he added that the environment in Springfield does change.

The proposal comes as two other Chicago sports teams, including the White Sox and Red Stars, have expressed interest in public funding for new stadiums.

Warren, who replaced the retired Ted Phillips a year ago, played a role in the construction of U.S. Bank Stadium in Minneapolis through a public-private partnership when he worked in the Minnesota Vikings’ front office from 2005 to 2019.

The Bears spent $197.2 million more than a year ago to purchase the site of the shuttered Arlington International Racecourse from Churchill Downs Inc. They envisioned building a stadium on the 326-acre tract of land some 30 miles northwest of Soldier Field, with restaurants, retail and more on the property — all for about $5 billion, with some taxpayer help.

The Bears had said they would pay for the stadium in Arlington Heights, with taxpayer dollars covering infrastructure costs such as roads and sewers. Those plans stalled, with the team citing a property assessment it said was too high.

They would remain tenants by staying in Chicago rather than owning a stadium in Arlington Heights. But Warren said he sees it as more of a partnership with the city rather than a landlord-tenant relationship.

“I believe in Mayor Johnson,” Warren said. “I believe in his staff, his vision, I believe in this city. I don’t look at it as being a renter. I look at it as being able to develop a relationship, to be able to come together. People asked that same question in Minnesota — why would you want to be a renter?”
